Heard learned counsel for the Petitioners and learned Additional Government Advocate for the State.

The petitioners have filed this writ application with the

following prayer:-

“ The petitioners therefore, pray that this Hon’ble Court may graciously be pleased to admit this petition, issue notice to the opposite parties by considering the facts and grounds stated above a direction may kindly be issued to the Tahasildar, Kandhamal not to issue the final ROR in Hal Khata No.22 and Khata No.35 respectively MouzaSainpada and Baikhol until the disposal of the R.P. Case No.31 of 2026 now pending in the Court of the learned Revenue Divisional Commissioner, Berhampur.

And such other order/orders, direction/directions as this Hon’ble Court may deem fit and proper in favour of the petitioner.

And for this act of kindness, the petitioner shall as in duty bound ever pray.”

It is submitted that pursuant to order dated 31.07.2026 passed by this Court in W.P.(C) No.22393 of 2026, the petitioners have

filed revision under Section 15(b) of the OSS Act before the RDC, Berhampur registered as R.P. Case No.31 of 2026. He apprehends that during pendency of the revision petition the Tahasildar may issue the final ROR in favour of some other person.

Since the revisional Court is competent to pass appropriate interim orders, the Writ Petition is disposed of granting liberty to the petitioner to seek appropriate interim relief by filing necessary application in the pending revision. If such application is moved, the revisional authority shall consider the said application at the earliest.
