The document submitted by the petitioner for registration was refused by the Registering Officer by endorsing the following on the body of the e-stamp foil:

“Registration is refused under Section 22-A(2) of registration (Odisha Amendment) Act, 2013. The reason for refusal is recorded in Book-II Register. Return the original document along with its true copy to the presentant.”

Neither the petitioner nor this Court can comprehend the reasons for which the registration was refused. Furthermore, the reasons have been supposedly mentioned in Book-II register, as if the same is available to be viewed by all and sundry. This is an entirely erroneous approach which cannot be countenanced in law.

The matter is remitted to the Registering Officer to record detailed reasons for refusing to register the document under intimation to the petitioner. If need be, the petitioner shall also be granted an opportunity of hearing. The earlier order of refusal shall not come in the way of the Registering Officer in considering the document for registration afresh.
