Upon hearing Md. G. Madani, learned counsel for the petitioner, the prayer to implead the Block Education Officer, Bhadrak as one of the opposite parties in the writ petition, as per I.A. No.17744 of 2026 filed in court, is allowed. The I.A. is kept on record.

The grievance of the petitioner is that the authorities are proceeding in giving posting to Level III teachers in Elementary Cadre violating Rule 9(5) of the Orissa Elementary Education

In course of hearing Md. Madani produces a copy of the letter dated 3^rd September, 2026 of the Director of Elementary Education.

Upon perusal of the same it is seen that the authorities are taking steps in issuing appointment orders in accordance with Rule 9(5) of 1997 Rules. Nothing is produced on record to reveal any contravention to such provisions of 1997 Rules.

At this stage Md. Madani, learned counsel for the petitioner prays that the representation of the petitioner under Annexure-7 is pending consideration before the authorities.

Accordingly the writ petition is disposed of at the stage of admission with a direction to the Block Education Officer, Bhadrak to consider the grievance of the petitioner as per his representation at Annexure-7, in accordance with law, within a period of two weeks from the date of receipt of certified copy of this order along with a copy of the writ petition.

An urgent certified copy of this order be issued on proper application.
