Heard Mr. G.R. Sethi, learned counsel appearing for the Petitioner and Mr. U.K. Sahoo, learned counsel appearing for Opp. Party No. 1.

The present writ petition has been filed inter alia with the following prayer:-

“It is therefore humbly prayed that this Hon'ble Court may graciously be pleased to admit the case, call for the records and after hearing both the parties pass the following reliefs;

i) To quash the order dtd. 20.09.2021 under Annexure- 7.

¶14

ii) To direct the Opposite Parties to appoint the petitioner under OCS (Rehabilitation Assistance) Rules, 1990.

And pass such other order/orders, direction/ directions as deem fit and proper.

And for this act of kindness, the petitioner as in duty bound shall ever pray.”

It is contended that in spite of the eligibility of the Petitioner, his claim to get the benefit of appointment under Rehabilitation Assistance Scheme was rejected vide the impugned order dtd.20.09.2021 under Annexure-7.

On his appearance Mr. U.K. Sahoo, learned counsel appearing for Opp. Party No. 1 fairly contended that Petitioner will be provided with the appointment as against a Group-D post in consideration of the application with recalling of the impugned order.

Learned counsel appearing for the Petitioner also fairly contended that Petitioner will have no objection, if she will be provided with appointment as against a Group-D post.

Having heard learned counsel appearing for the Parties and considering the submissions made, this Court while disposing the writ petition, directs Opp. Party No. 1 to provide appointment to the Petitioner as against a Group-D post by recalling the earlier rejection as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of this order.

The writ petition accordingly stands disposed of.
