Petitioner in this writ petition prays for a direction to the Land Acquisition Officer, Hemagiri in the district of Sundargarh to release the compensation amount in favour of the Petitioner or in the alternative, to dispose of the representation dated 17^th June, 2025 (Annexure-4), which is stated to be pending with the Opposite Party No.3.

Mr. Biswal, learned Additional Standing Counsel drew attention to Annexure-J/3 of the counter affidavit, which contains the copy of the order dated 30^th August, 2024 passed by Hon’ble Supreme Court in SLP(C) No.18924 of 2024. Relevant portion of the said order is reproduced hereunder:

“4. It seems that the interest of justice will be adequately met by directing the LARRA to verify the records and find out (1) whether Due amount of compensation has been paid to each affected land-owners and if not, the State of Odisha and its authorities are directed to release the due amount of

compensation along with statutory interest within a period of three months from the date of determination of claim by LARRA; (ii) whether any Rehabilitation and Resettlement Policy has been formulated, and if so, whether the claim of the affected land-owners was ever considered under such policy; (iii) If there is a Rehabilitation and Resettlement Policy, why the benefit of such policy be not extended to such land owners?

5. The LARRA shall pass an appropriate order in this regard within a period of three months from the date of receipt/production of a copy of this order. The concerned parties, including the State, shall be adequately heard before passing any order.

6. However, if LARRA finds that there are individual claims based upon facts which are distinct on a case to case basis, liberty shall be granted to the individual land-owners to pursue their remedy in accordance with law.”

Since the Petitioner claims release of compensation in his favour and the matter is pending before the LAR and R Authority, (Northern Division), Sambalpur, he may, if so advised, avail the remedy before the LAR and R Authority, (Northern Division), Sambalpur and raise his claim before the said Authority in accordance with law.
