The Petitioner in this Writ Petition prays for the following reliefs:

“(i) Not to acquire the home stead land of the petitioner who is a scheduled caste person and the said land is situated within Scheduled Area.

¶18

(ii) Not to acquire the home stead land of the petitioner without obtaining permission from the Gram Sabha /Panchayat.

¶19

(iii) Not to acquire the home stead land of the petitioner without resettling the family members of the petitioner within the scheduled area to retain their ethnic, linguistic and cultural Signature Not Verified Digitally Signed identity.”

Upon hearing learned counsel for the Petitioner and on perusal of the Writ Petition, this Court finds that the grievance of the Petitioner is with regard to erection of tower over his homestead land for drawal of high tension transmission line. Since the Petitioner has remedy under the provisions of the Telegraph Act, this Court is not inclined to entertain this Writ Petition.

Accordingly, the Writ Petition is dismissed. Dismissal of this Writ Petition shall not preclude the Petitioner to work out his remedy in accordance with law.
