This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.

Petitioner has filed the present writ petition inter alia with the following prayer:-

“Therefore, it is prayed that this Hon'ble Court may graciously be pleased to admit the writ application, call for the record, issue Rule NISI calling upon opposite party to show cause as to why the petitioner shall not be granted pay protection in the scale of pay 1480-2600 as on date of reposting dated 24.08.1997 in the office of Minor Irrigation, Bolangir from the office of DRDA, Mayurbhanj and as to why the service book shall not be updated with the fixes of pay and pension. Failing to show cause or showing insufficient cause issue the writ of mandamus directing the opp. parties to grant pay protection with the scale of pay Rs. 1480-2600 as on date 24.08.1997 and to update the service book, in the light of the judgment passed by this Hon'ble Court in the case of Dilli Ranjan Khuntia-vrs-State of Odisha.

Pass such other writ (s)/ order (s) / direction (s) as may be deemed fit and proper.

And for this act of kindness, the petitioner as in duty bound shall ever pray.”

Learned counsel for the Petitioner submits that though highlighting his grievances, Petitioner has filed a representation at Annexure-3 to the Writ Petition before the Opp. Party No. 4, but till date nothing has been done in the matter. In such background, learned counsel for the Petitioner prays that a direction be issued to Opposite Party No. 4 to take a decision on the above noted Petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs Opposite Party No. 4 to take a decision on the above noted petition in accordance with law, within a period of three (3) months from the date of receipt of this order and communicate the result of such exercise to the Petitioner.

The Writ Petition is disposed of accordingly.
