Petitioner in this writ petition prays for a direction to the Opposite Parties to permit him to shift the kiosk allotted in his favour at Ashok Nagar to any place near book market situated near Master Canteen or allot any alternative kiosk in his favour near book market situated at Master Canteen, Bhubaneswar.

Mr. Dhal, learned Counsel for the Petitioner submits that the grievance of the Petitioner in this writ petition was with regard to non-consideration of his representation by the Bhubaneswar Municipal Corporation.

He however submits that in the meantime, Counter Affidavit has been filed by the Bhubaneswar Municipal Corporation stating that the representation filed by the Petitioner with the aforesaid prayer has already been rejected.

In view of the above, Mr. Dhal, learned Counsel for the Petitioner prays for withdrawal of the writ petition seeking liberty to file a fresh one with better particulars challenging the order of rejection of his representation.

Mr. Panda, learned Counsel for Bhubaneswar Municipal Corporation does not have any objection to such prayer.

Accordingly, the writ petition is disposed of as withdrawn with liberty to the Petitioner to file a fresh one with better particulars within a period of one month hence.
