Heard learned counsel for the Petitioner and learned counsel for the State-Opposite Parties.

The Petitioner has filed the present Writ Petition inter alia with the following prayer:-

Under the aforesaid facts and circumstances, it is humbly therefore prayed that this Hon’ble Court may graciously be pleased to issue a writ in the nature of mandamus or any other appropriate writ/writs by quashing the impugned order dated 04.09.2023 passed by the opp. party No.1 under Annexure-20.

And further be pleased to direct the opp. party No.1 to extend the benefit as has been extended in favour of WPC(OAC) No.2938/2018 vide order dated 31.01.2023 under Annexure-22;

It is contended that the issue involved in the present case is covered by an order passed by this Court on 31.01.2023 in WPC(OAC) No.2938 of 2018.

Learned Additional Standing Counsel though raised certain objections with regard to the applicability of order dated 31.01.2023 to the facts of the present case but this Court is of the view that the claim as made in the present Writ Petition is squarely covered by order dated 31.01.2023.

In view of the same, this Court, while quashing impugned order dated 04.09.2023 so passed by O.P. No.1 under Annexure20, disposed of the Writ Petition in the light of the order dated 31.01.2023 passed by this Court in WPC(OAC) No.2938 of 2018.
