“The petitioner, therefore, pray that the Hon’ble Court be pleased to admit the writ petition and issue notice to the opp. parties and after hearing the parties, the Hon’ble Court be pleased to direct the opp. party No.2 to record the case land in the name of the petitioners as per the order of opp. party No.1 in Annexure-3 and consequently the Map to be corrected by a writ of certiorari/mandamus and any other appropriate writ or order in the facts and circumstances of the case;

By order dated 10.11.2021 passed in Revision Petition No. 4256 of 2003, the Additional Commissioner, Settlement and Consolidation, Board of Revenue, Odisha, inter alia, directed as follows:-

“Considering the claim of the petitioners and after making observation as aforesaid facts it is found that the claim of the petitioners as sought in this revision is genuine one. Thus, the revision is allowed and the Tahasildar, Cuttack Sadar is directed to correct the Hal R.O.R. and record the schedule land in the names of petitioners exclusively in a separate Khata and plot after verifying the original relevant documents, Hal-Sabik corelation, ascertaining the physical possession following due procedure.

Hal Settlement Khata No. 12, Hal Plot No. 58 “SaradaII” area Ac.0.060 decimals out of area Ac. 0.073 decimals. Corresponds to Sabik Plot No. 23 (p) area Ac.0.060 decimals under Sabik Khata No. 545.”

It is the grievance of the petitioners that, despite such clear order passed by the revsional authority, the Tahasildar has not acted upon it as yet.

Considering the limited grievance, the writ petition is disposed of directing the Tahasildar, Sadar, Cuttack to carry out the directions of the revisional authority as quoted above without any further delay and in any case not later than six weeks from the date of production of certified copy of this order by the petitioners.
