Ms. S. Mishra, learned counsel for the Opposite Party No.4OMFED submits that there is an agreement executed between the Petitioner regarding permissive possession for functioning of the OMFED Booth. There is no threat of eviction for the Petitioner by Opposite Party No.4.

Mr. Patnaik, learned counsel for the Petitioner submits at this stage that Opposite Party No.3, i.e. the Assistant Engineer, Road and Building Department, Chandrasekharpur is threatening for eviction of the Petitioner. But no such notice of eviction or order of eviction is produced on record.

Keeping the status of Opposite Party No.3 in view, there cannot be any reasonable apprehension on the part of the Petitioner for his eviction by Opposite Party No.3.
