Heard learned counsel for the Petitioner as well as learned counsel for the State-Opposite Parties. Perused the writ petition as well as the documents annexed thereto.

The present writ petition has been filed by the Petitioner with the following prayers:-

“ Under the above circumstances, it is humbly prayed that the writ petition may be allowed;

And

¶23

(A) a writ of Mandamus or an appropriate writ may be issued the opposite parties more particularly to the District Education Officer, Kalahandi - opposite party No.3 not to bring back the petitioner from Government High School, Ghodabandh to Government High School, Nunpur as she has not been transferred on the recommendation of the Hon'ble M.P/M.L.A rather she has been transferred to Government High School, Ghodabandh on spouse ground and because of her ailment and she may be allowed to

continue in Government High School, Ghodabandh as she has joined in the said School on 26.07.2025 and she has just completed seven months of service in the said School, within a time to be stipulated by this Hon'ble Court;

(B) And any other order / orders or direction / directions may be issued so as to give complete relief to the petitioner. ”

Learned counsel for the Petitioner, at the outset, contended that ventilating her grievance, the Petitioner has already approached the District Education Officer, Kalahandi, Opposite Party No.3 by filing a representation dated 03.01.2026 under Annexure-4 to the writ petition.

The sole grievance of the Petitioner in the present writ petition is that although the Petitioner had approached the Opposite Party No.3 in the month of January, 2026, however the grievance of the Petitioner still remains un-redressed and the representation of the Petitioner still pending before Opposite Party No.3.

Learned counsel for the State, on the other hand, contended that he has no specific instruction in the matter, however taking into consideration the limited nature of grievance involved in the present writ petition, he will have no objection in the event this Court directs the Opposite Party No.3 to consider and dispose of the representation of the Petitioner, if the same is still pending, strictly in accordance with law within a stipulated period of time.

Considering the submissions made by the learned counsels appearing for the respective parties and without expressing any opinion on the merits of the case, this Court disposes of the writ petition at the stage of admission with a direction to the Opposite Party No.3 to consider the representation of the Petitioner dated 03.01.2026 under

Annexure-4 in accordance with law within a period of four weeks from the date of production of a certified copy of this order. It is needless to mention here that the representation of the Petitioner shall be considered and disposed of by passing a speaking and reasoned order. Any decision so taken on the said representation shall be communicated to the Petitioner within ten days thereafter.

Urgent certified copy of this order be granted on proper application.
