1. Heard learned counsel for the Parties.

By means of this application, the Petitioner seeks the following relief:-

“It is therefore prayed that this Hon'ble court would graciously be pleased to issue Rule Nisi calling upon the opp.parties to show cause as to why the impugned notice under Annexure-1 passed by the Learned Tahasildar, Bari in Encroachment Case No.4-74/2026 shall not be quashed/set aside, and if the opp. parties failed to show cause or show insufficient or false cause make the Rule Nisi absolute and allow this writ petition with cost.

And to pass any other relief/relies this Hon'nie court deems fit and proper

And for this act of kindness, the petitioners as in duty bound shall ever pray.”

In course of hearing, the learned counsel for the Petitioner submits that the Petitioner has been issued with a notice from the Tahasildar, Bari in encroachment Case No.4-74/2026, a copy thereof has been placed in Annexure-1.

On being enquired, learned counsel for the Petitioner submits that an objection has been filed to the aforesaid notice on 13.02.2026. Needless to say that pursuant to the submission of the objection as stated has been filed on 13.02.2026, the authority i.e. Additional Tahasildar, Bari is required to consider the same in accordance with law and dispose thereof; the result whereof be communicated to the Petitioner thereafter. The entire exercise of the authority shall be completed within a period of three weeks.
