4. Learned counsel for the Respondent Nos.1-6/ Claimants files a memo stating therein that the Respondent No.4- Surubali Singh has died on 18.09.2025 leaving behind her legal heirs who are already on record i.e. Respondent Nos.1, 2, 3, 5 and 6. Hence, no substitution is required.

5. In such view of the matter, the name of the Respondent No.4Surubali Singh be deleted from the cause title of the brief.

The Appellant/ Insurance Company has filed this MACA challenging the judgment and award dated 24.12.2022 passed by the learned 6^th Motor Accident Claims Tribunal, Karanjia in MAC Case No.70 of 2012 thereby directing the Appellant/ Insurance Company to pay award amount of Rs.9,44,370/- (Rupees nine lakh forty-four thousand three hundred seventy only) to the Respondent Nos.1- 6 /Claimants with interest @ 6% per annum from the date of filing of the application till payment.

At present, on the basis of the compromise made between the parties, the claim is settled by modifying/ enhancing the awarded amount of Rs.9,44,370/- (Rupees nine lakh forty-four thousand three hundred seventy only) with a consolidated amount of Rs.11,50,000/(Rupees eleven lakh fifty thousand only). The Insurance Company undertakes to deposit the modified award amount before the learned 6^th Motor Accident Claims Tribunal, Karanjia in MAC Case No.70 of 2012 within a period of eight weeks hence.
