This criminal revision has been filed seeking to quash the proceeding in 1CC No.16 of 2025 for the offence under Section 138 of NI Act pending on the file of the learned J.M.F.C. (Cog. Taking), Jharsuguda. 3. During the course of hearing, attention of this Court is drawn to paragraph-7 of the Revision, which reads as under:-

<That, the Learned Trial Court has communicated/directed the Lawyer for the petitioner-accused not to press the petition under Section 228 of BNSS, 2023 corresponding to Section 205 of Cr.P.C. as it would start the proceeding afresh. That on a bare perusal if the order sheet of ICC No. 16/2025 is looked upon then it can be well

evident that the order sheet has not also been maintained in ICC No. 16/2025.=

Prima facie, this Court is of the considered view that in the absence of any material on record to fortify the allegations, as quoted above, this Criminal Revision in its present form cannot be entertained.
