Assailing the order dated 19.03.2026, rejecting the prayer of the Petitioner, who is an accused for commission of the offences under Section 318(4)/336(2)/336(3)/340(2)/351(3)/61(2)/3(5) of BNS, for defreezing the account, the present Criminal Revision has been filed.

It is the submission of Mr. Sharma, learned Senior Counsel assisted by Mr. Sahoo, learned counsel for the Petitioner that in view of the filing of the charge sheet, the order rejecting the prayer for defreezing the account, smacks of non-application of

mind and such defreezing is not going to affect the merits of the prosecution case.

In response to such submission, this Court vide order dated 24.06.2026 directed the I.O. of the case at hand to file an affidavit. 5. Referring to the same, it is submitted by the learned counsel for the State that the Petitioner along with the co-accused who is also the Petitioner in CRLREV No.309 of 2026, are involved in these following cases including the case at hand:-

“i. Sambalpur Town P.S. Case No.227 of 2024 U/s.419/420/468/471/109 of IPC.

ii. Town P.S. Case No.85 of 2025 U/s.318(4)/ 336(2)/336(3)/340(2)/351(3)/61(2)/3(5) of BNS.

iii. Town P.S. Case No.94 of 2025 U/s.419/420/468/471/120-B of IPC.”

Hence, the prayer for defreezing of account ought not to be allowed.

By order dated 24.06.2026, this Court also sought response of the Petitioner for securing the amounts which are said to proceeds of the crime. 7. In response thereto, the Petitioner who ordinarily resides within the territorial jurisdiction of the Court in seisin files an affidavit indicating the properties which can be offered as security. 8. The claim of the Petitioner regarding the value and title was asked to be verified by order dated

24.06.2026. On such verification, the I.O. in paragraph-8 of the affidavit has stated thus:-

It is relevant to mention here that from the reports of the Tahasildar, Maneswar and SubRegistrar, Maneswar regarding genuineness of Khatian No.282/322 and Bench Mark Valuation thereof, it is found that the property furnished by the Petitioner situated at Maneswar presently stands in the name of Venkat Balaji Patra. However, there is suspicion regarding the manner in which the said property was acquired, and it requires thorough investigation to ascertain whether the registration or acquisition was made through lawful means. Copies of report No.1980 dated 09.07.2026 of the Tahasildar, Maneswar and No.1175/Regn. Dated 9.07.2026 of the SubRegistrar, Maneswar are annexed herewith as Annexure-B Series.

On considering the rival submission, taking into account that in the case at hand charge sheet has already been submitted and the Petitioner has furnished security which is found to be adequate, this Court is persuaded that the impugned order is liable to be interfered with.

The accounts in question (Account No. 150001500818 maintained with ICICI Bank) be defreezed Bhubaneswar subject to the Petitioner furnishing the security in terms of Paragraph-8 of the affidavit as referred to hereinabove. The property

furnished as security shall not be encumbered till the disposal of the lis before the Trial Court.

Intimation in this regard shall be sent to the office of concerned Tahasildar and Sub-Registrar.

Such security as furnished shall abide by the final outcome of the lis.

Liberty is granted to the learned counsel for the State to seek variance of this order, if so advised, in the event the security furnished is found to be not genuine or subject matter of litigation.

Accordingly, the CRLREV stands disposed of.
