No. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

Assailing the order dated 09.12.2025 passed by the learned District & Sessions Judge, Bhadrak in Criminal Appeal No-66/2025 directing the Petitioner to deposit 20% of the compensation amount of Rs.2,20,000/- within two months, the present criminal revision has been filed. 3. It is submitted by the learned counsel for the Petitioner that because of the financial constraint he is not in a position to deposit this amount within the time as stipulated and seeks extension of such period to comply the order.

It is also submitted that it is the settled position of law that direction to deposit 20% in terms of Section 1481 of the NI Act, can be varied.

Taking into account the impugned order and the submissions made and the recitals in the revision petition, this Court modifies the impugned order by extending the period of payment till 06.04.2026.

It is needless to state that nonpayment in terms of the order passed by the learned Appellate Court shall not be treated as a violation of the order passed by the said Court.

In the event the amount of Rs.45,000/- is not deposited by the extended date of 06.04.2026 as undertaken, it shall be open for the learned Appellate Court to proceed in accordance with law.
