Heard learned counsel for the Petitioner and learned counsel for the State.

Being aggrieved by imposition of cash security of Rs.20,000/- while directing release of the vehicle of the Petitioner, involved in commission of offence by order dated 07.11.2023 passed by the learned Sessions Judge-cum-Special Judge, Khurda, Bhubaneswar in C.M.C. No.100 of 2023 arising out of TR No.208 of 2023 the present revision has been filed.

The condition imposed by the learned Special Judge which is assailed is extracted hereunder;

It is submitted by the learned counsel for the Petitioner that the direction relating to imposition of cash security is causing hardship and the same may be modified.

It is submitted by the learned counsel for the State that taking into account the nature of allegation by no stretch of imagination it can be said that imposition of such cash security is harsh.

Considering the rival submissions, the condition relating to cash security as imposed by the learned Sessions Judge-cum-Special Judge, Khurda, Bhubaneswar is reduced from Rs.20,000/to Rs.5,000/-. Other conditions remain unaltered.
