Heard learned counsel for the respective parties.

Instant CRLMP is filed by the petitioner for a direction to the opposite parties and in particular, opposite party No.3 to register the FIR on the basis of the complaint dated 17^th November, 2024 at Annexure-1 with such other reliefs sought for on the grounds stated.

Ms. Samal, learned counsel submits that there is medical negligence on the part of the accused named in the complaint but even after lodging of the same, no case has been registered. The further claim is that intimation has been given to opposite party No.2 as per Annexure-2 but it has not yielded any result. The claim is that the said intimation has been received by opposite party No.2 in the meantime sent by Post referring to the postal receipt at Annexure-3 and the postal tracking report i.e. Annexure-4. Recording such submission and since a complaint is lodged by the petitioner alleging negligence on the part of a doctor, this Court recording the

submission of Mr. Mohanty, learned ASC for the State is inclined to direct opposite party No.3 to examine the same and if in case, a gross medical negligence is prima facie proved, to take appropriate legal action and if necessary, to register the same as FIR and proceed thereafter in accordance with law.

Hence, it is ordered.

In the result, the CRLMP stands disposed of with the direction as aforesaid for compliance by opposite party No.3 soon after receiving a copy of this order.

Issue urgent certified copy of this order as per rules.

A copy to the State for intimation to opposite party No.3 for early compliance.
