High Court of Orissa at Cuttack, CRLMC No.605 of 2026 (order dated 13.07.2026), coram Dr. Justice Sanjeeb K Panigrahi (sole judge): The CRLMC filed by Debendra Kumar Bag & Ors. was disposed of without adjudication because, as reported by learned counsel and confirmed by the Mediator's sealed-cover report (opened in Court) recording the mediation proceeding of 10.05.2026 between Mr. Debendra Kumar Bag and Mrs. Akshyamita Kartik, the underlying dispute had already been resolved through mediation. Settlement terms recorded: (i) return of the Maruti Suzuki Brezza (Regn. No.OD-08-Q-2383) to the wife after clearing unpaid bank hypothecation dues, transfer of registration and servicing, on or before 10.08.2026; (ii) joint intimation to the Hon'ble High Court in TRP(C) No.465 of 2025 of the settlement with a request for out-of-turn listing, so that CP No.50 of 2025 initiated by the husband at Family Court, Bhawanipatna is transferred to Family Court, Jeypore, Koraput, followed within one week by a mutual-divorce filing via joint affidavit with no alimony claimed by the wife except return of the vehicle and 40 gms. of gold in lieu of marriage ornaments; (iii) the wife's consent to quashing of Jeypore Mahila P.S. 1. This matter is taken up through hybrid arrangement.

¶14

2. Heard learned counsel for the respective parties.

¶15

3. At the outset, learned counsel for the Petitioners submits that in the meantime, both the parties have already resolved the dispute involved herein through the process of mediation.

4. A report to that effect has already been submitted by the concerned Mediator. The said report submitted through a sealed cover is opened in Court today. The contents of the proceeding before the learned Mediator on 10.05.2026 are extracted herein below:-

Kartik & her ld. Counsel Mr. S.Kar are present. The mediator explained to both parties the purpose of mediation and advised them to have a mutual discussion to see if their disputes could be amicably settled. Accordingly Mr. Debendra Kumar Bag & Mrs. Akshyamita Kartik had a discussion whereafter both expressed the mediator their desire to have the matter finally settled on terms agreed to by the parties.

The parties were counseled together, separately and also in presence of their respective ld. Counsels.

The following terms of settlement have been agreed upon as follows:

(i) Mr. Debendra Kumar Bag shall return to Mrs. Akshyamita Kartik the Maruti Suzuki Brezza having registration No.OD-08-Q-2383 after clearing the unpaid hypothecation dues to the bank, transfer the registration in favour of Mrs. Akshyamita Kartik and after getting it serviced and checked up from the authorized dealer on or before 10.08.2026.

(ii) Both parties shall jointly inform the Hon’ble High Court in TRP(C) No.465 of 2025 of the settlement reached by them and for listing it out of turn so that transfer can be effected of CP No.50 of 2025 initiated by the husband at Family Court, Bhawanipatna to the Family Court, Jeypore, Koraput and upon transfer to Jeypore they shall within one week thereafter seek mutual divorce by filing joint affidavit with no alimony to be claimed by the wife except the return of Maruti Sukuzi Brezza registration No.OD-08-Q-2383 & 40 gms. of gold in lieu of ornaments given at the time of marriage.

(iii) In CRLMC No.605 of 2026 filed by Mr. Debendra Kumar Bag and others, Mrs. Akshyamita Kartik shall give her consent for proceedings in Jeypore Mahila P.S. Case No.139 of 2025 initiated at her instance being quashed in view of this settlement arrived at between the parties.

(iv) Both the parties have agreed that neither of them will contact of other through any electronic media or the cell-phone nor shall broadcast any personal chats/ messages to others. Mediation stands concluded.”

5. Considering the above submission and looking to the report of the learned Mediator quoted hereinabove, this Court is of the view that no purpose will be served in keeping the present CRLMC pending as the dispute involved herein has already been resolved through the process of mediation.
