1. This matter is taken up through hybrid arrangement.

2. The Petitioner has filed this CRLMC assailing the order of issuance of NBW(A) dated 17.05.2024 passed by the learned A.S.J., Aska in Sessions Trial Case No.322 of 2025 arising out of Gangapur P.S. Case No.64 of 2014 corresponding to G.R. Case No.313 of 2014, pending in the Court of learned Addl. Sessions Judge, Aska.

3. Heard learned counsel for the Petitioner and learned Counsel for the State.

4. Learned counsel for the Petitioner submits that the Petitioner was granted bail vide order dated 12.08.2014 in BLAPL No.1417 of 2014 and had been regularly attending the Court on each date of posting of the case. However, on

17.05.2024, the Petitioner could not remain present in Court due to non-communication by the conducting Counsel. Hence, the learned Court in seisin over the matter issued the order of N.B.W. against him. He further submits that the Petitioner undertakes to co-operate till the end of the trial and appear before the learned Court below on each date of posting of the case without fail.

5. Considering the conduct of the Petitioner and further taking into account that the N.B.W.(A) has remained pending since 17.05.2024 without any steps having been taken by the Petitioner in the meantime, this Court is not inclined to interfere with the order passed by the learned trial Court.

However, the Petitioner is directed to surrender before the learned Court in seisin of the matter in the aforesaid case within a period of fifteen (15) days from the date of this order and to move for bail. Upon such application being filed, the same shall be considered and disposed of by the learned Court in accordance with law.

7. Accordingly, this CRLMC is disposed of.
