1. Mr. Manas Kumar Chand, learned counsel has entered appearance on behalf of the opposite party no.2 by filing Vakalatnama in the Court today. The said Vakalatnama is taken on record.

2. The present CRLMC is directed against the interim order dated 04.05.2022 passed by the learned S.D.J.M., Bhubaneswar under Section 25 of the P.W.D.V. Act and the order affirmed by the learned Sessions Judge, Khurda in Criminal Appeal No.31 of 2022. By the impugned order, the appellate Court, inter alia, directed as under:

“7. In the premises, taking into consideration, the above facts & submissions, the impugned order dtd. 04.05.2022 is modified to the extent that as

against house rent, electric bill & water bill, the Respondent No.1 shall pay a sum of Rs.20,000/per month to the Appellants from the date of this order in place of accommodation. It is further directed that the Respondent No.1 shall also furnish the school tuition fees receipts of Appellant No.2 before the learned trial Court after clearing the dues, if any, by the end of March, 2024 and shall continue to bear the educational expenses of the Appellant No.2 in addition to the interim maintenance order awarded by the learned trial Court.

On the above observations, the Appeal stands disposed of on contest against the Respondents.”

Mr. Chand, learned counsel appearing for the opposite party no.3 submits that in the meantime, the Civil Proceeding initiated by the petitioners for dissolution of marriage has already been allowed with a direction to pay a sum of Rs.10,00,000/- as permanent alimony to the respondent wife. Cross appeals have been filed by both the parties which are pending consideration before the Hon’ble Division Bench of this Court.

4. In view of the subsequent development, this Court feels it appropriate to dispose of the present petition with liberty to the petitioners to resort to the appropriate remedy under law. Moreover, the D.V. case initiated by the opposite parties and the minor daughter being C.M.C. No.227 of 2022 is still pending before the learned S.D.J.M., Bhubaneswar. Liberty is also granted to the opposite parties to initiate appropriate proceeding to execute the order which
