1. This matter is taken up through hybrid arrangement.

2. By filing the present CRLMC, the Petitioner has prayed for issuance of a direction to the learned trial Court for expeditious disposal of Crl. Misc. Case No.16 of 2021, which is presently pending before the learned S.D.J.M., Banki, within a stipulated time frame.

3. Heard learned counsel for the parties. Perused the materials available on record.

Learned counsel for the Petitioners submits that the Petitioner had approached the learned S.D.J.M., Banki by filing an application under Section 125 of the Code of Criminal Procedure seeking maintenance, which has been registered as Crl. Misc. Case No.16 of 2021. It is contended that the said proceeding has been pending for an inordinate period without any substantial progress. The Petitioners are regularly attending the Court with a legitimate expectation of

securing maintenance. However, it is alleged that the Opposite Party, being local resident, is seeking repeated adjournments and is deliberately protracting the proceeding.

5. Learned counsel for the Petitioners further submits that in the interest of justice and to prevent abuse of the process of Court, this Court may be pleased to issue necessary directions to the learned trial Court to ensure expeditious disposal of the aforesaid case within a time-bound manner.

Upon hearing learned counsel for the Petitioners and upon perusal of the record, this Court is of the considered view that the ends of justice would be met if a direction is issued to the learned trial Court, i.e., the S.D.J.M., Banki, to make all endeavour to dispose of Crl. Misc. Case No.16 of 2021 at the earliest possible, preferably within a stipulated period, without granting unnecessary adjournments to either of the parties, subject to cooperation by both sides.

7. With this observation, the CRLMC stands disposed of.

8. Pending application (s), if any, stand disposed of accordingly.

9. A copy of this order be communicated to the learned trial Court for information.
