1. These matters are taken up through hybrid arrangement.

¶12

2. Since common question of facts and law are involved in both the above mentioned CRLMCs, the same are heard together and disposed of by this common order. However, this Court feels it apposite to deal with the CRLMC No.1039 of 2026 as the leading case for proper and effective adjudication of both the cases.

4. In filing the CRLMC No.1039 of 2026, the Petitioner serving as the Chief Manager-cum-Legal Officer at Zonal Office of Bank of Baroda, Bhubaneswar, has prayed for quashing the entire criminal proceeding initiated against her vide Kendrapara Sadar P.S. Case No.0347 of 2023 corresponding to G.R. Case No.1360 of 2023 and

Kendrapara Sadar P.S. Case No.0085 of 2024 corresponding to G.R. Case No.287 of 2024 pending before the Court of learned S.D.J.M, Kendrapara.

Challenging initiation of the above noted criminal proceeding, learned counsel for the Petitioner submits that both the proceedings have been initiated against the Petitioner at the time of conducting of recovery of the loan amount from the loanees when they were in their respective houses. He further contends that since the loanees/ complainants were defaulter in making payment of their respective loan outstanding dues, the Petitioner on her Official capacity attempted to made necessary recovery from them as per the rules meant for the said purpose and also in presence of the Police personnel. He, in the process, submits that such act of the Petitioner triggered initiation of the above noted criminal proceeding against her. He, accordingly, prays for allowing the prayer made in this CRLMC.

At this juncture, pursuant to the earlier order of this Court, learned counsel for the respective parties, in one tone, submit that the final report pertaining to the present Petitioner has already been submitted since 10.09.2024. They also submit that the Petitioner has been discharged from the charges levelled against her in the above noted criminal case. Hence, nothing survives in the present

CRLMC vide CRLMC No.1039 of 2026 to be adjudicated upon by this Court any further. Copy of the final report pertaining to the above noted criminal case submitted before this Court be kept on record.

7. Considering the above statement and since the Petitioner has been discharged from the charges levelled against her, this Court is of the view that nothing survives in the present CRLMC vide CRLMC No.1039 of 2026 to be adjudicated upon by this Court any further.

8. The CRLMC No.1039 of 2026 is, accordingly, disposed of as infructuous.

9. In view of disposal of CRLMC No.1039 of 2026, the connected CRLMC vide CRLMC No.2619 of 2024 is also disposed of.
