This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is an application U/S. 430 of BNSS by the petitioner seeking grant bail to the petitioner who is appellant in Criminal Appeal No. 15 of 2025 pending in the file of learned Sessions Judge, Kalahandi, Bhawanipatna, who by the impugned order dated 17.09.2025 passed in the above criminal appeal refused to grant bail to the appellantpetitioner by not suspending his sentence.

Heard, Mr. Karunakar Gaya, learned counsel for the petitioner and Mr. T.K. Acharya, learned Addl. PP in the matter and perused the record. 4. It is not disputed that the petitioner has been convicted for commission of offences punishable U/Ss. 420/465/468 of IPC and is accordingly, sentenced by the learned Chief Judicial Magistrate, Kalahandi, Bhawanipatna in C.T. Case No.1170 of 2024/T.R. Case No. 71 of 2025 to undergo maximum

Rigorous Imprisonment (RI) for five years with fine of Rs.50,000/-, in default whereof, to under RI for further six months for each offence U/Ss.420/468 of IPC with lesser punishment for offences U/S. 465 of IPC and all the sentences are directed to run concurrently, but the petitioner has already suffered imprisonment for 8 months 13 days as on the date of judgment by the learned trial Court on 09.07.2025 and thereafter, since then till today and thereby, the petitioner has already undergone more than one year and eight months, however, the appeal is yet to be disposed of.

In the aforesaid facts and situation, this Court considers that the petitioner has made out a case for grant of bail and suspension of sentence. 6. Accordingly, the CRLMA stands allowed and the Petitioner is allowed to go on bail pending disposal of the appeal on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) only with one solvent surety for the like amount with further conditions as deems fit and proper by the learned Convicting Court and accordingly, the sentence of the appellant-petitioner be suspended till disposal of the appeal.
