1. This matter is taken up through Hybrid mode.

Heard learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein.

By filing the present application under Article 227 of the Constitution of India, the plaintiff in C.S. No.1 of 2023 pending in the Court of learned Civil Judge-cum-J.M.F.C., Erasama has approached this Court for a direction to the learned trial Court to dispose of the suit as expeditiously as possible.

On perusal of the CMP application, it appears that the plaintiff-Petitioner filed C.S. No.1 of 2023 for declaration of easementary rights of the plaintiff’s family over the suit land and other consequential release.

Learned counsel for the Petitioner at this stage contended that the suit is at a very advanced stage and argument in the matter is going on at the moment. In such view of the matter, learned counsel for the Petitioner contended that the learned trial Court be directed to expedite the trial of the suit and the same should be disposed of at the earliest.

Taking into consideration the submission made by the learned counsel for the Petitioner, further considering the fact that the suit is of the year 2023, this Court is not inclined to grant any specific order with regard to disposal of the suit. However, liberty is granted to the Petitioner to move the learned trial Court for an early disposal of the suit. In such eventuality, the learned trial Court shall consider such prayer as per law and in the event there is no other impediment, every endeavor shall be made to expedite the trial of the suit. Parties are directed not to take unnecessary adjournments in the matter and to cooperate with the learned trial Court for early disposal of the suit.

With the aforesaid observation/direction, the CMP application stands disposed of.
