Heard Mr. A.P. Bose, learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein.

By filing the present CMP application under Article 227 of the Constitution of India, the Petitioner has prayed for a direction to the learned trial court to dispose of I.A. No.92 of 2024, arising out of C.S. No.396/679 of 2023, which has been filed by the Plaintiff-Petitioner for appointment of a receiver and such application is pending for adjudication before the learned Civil Judge, Senior Division, Soro.

Learned counsel for the Petitioner, at the outset, contended that although the application for appointment of a receiver has been filed at the instance of the PlaintiffPetitioner since 2024, however the same being adjourned from time to time and no final decision has been taken on the same. Being aggrieved by such inaction on the part of the learned trial court, the Petitioner has approached this Court by filing the present CMP application.

Taking into consideration the limited nature of the grievance involved in the present CMP application, this Court deems it proper to dispose of the present CMP application by granting liberty to the Petitioner to move the trial court for early disposal of the I.A. No.92 of 2024, arising out of C.S. No.396/679 of 2023, pending before the learned Civil Judge, Senior Division, Soro within two weeks from today. In such eventuality, learned trial court shall do well to dispose of the said I.A. within eight weeks after providing opportunity of hearing to both parties.

With the aforesaid observation and direction, the CMP stands disposed of.
