1. This matter is taken up through hybrid arrangement.

2. In filing the present CMP, the Petitioner being the Defendant No.1 in the proceeding below vide C.S. No.17 of 2021-I, has challenged the impugned order dated 31.01.2026/Annexure-8 passed by the learned Civil Judge (Sr. Divn.), Basudevpur in I.A. No.1 of 2026. The Petitioner has also sought for a direction from this Court to the learned Court in seisin over the matter for permitting him to construct his pucca house over the suit scheduled property in question.

At the outset, pursuant to the query made by this Court learned counsel for the Petitioner submits that pleadings

in the above noted Civil Suit vide C.S. No.17 of 2021-I are already completed and the suit is ready for argument.

5. In such view of the matter, this Court is not inclined to entertain the prayer made in the present CMP. However, since the pleadings in the above noted Civil Suit are already completed, this Court requests the learned Civil Judge (Sr. Divn.), Basudevpur to take proactive steps for concluding the C.S. No.17 of 2021-I within a period of three months from the date of presentation of an authenticated copy of this order.

6. This CMP is, accordingly, disposed of.
