This is the bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Sambalpur Mahila PS Case No. 75 of 2023 corresponding to GR Case No.2020 of 2023 pending in the Court of learned SDJM, Sambalpur for commission of offence punishable U/Ss.498-A/376(2)(n)/506/34 of IPC r/w Section 4 DP Act, on the main allegation of committing rape upon the victim by subjecting her to torture and cruelty and threatening her for demand of dowry, along with co-accused persons in furtherance of their common intention.

Heard, Mr. Ranjit Mohanty, learned counsel for the petitioner; Mrs. Mamuni Samantaray, learned counsel for the victim and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record. It is advanced for the Petitioner that it’s a false and motivated case and the present case has seen the light of

the day after the husband of the Petitioner lodged the case against the Petitioner for cruelty to him, but Mrs. Samantaray, learned counsel for the victim, however, strongly refutes such submission by contending inter-alia that not only the victim is ravished by the Petitioner, but also the entire family members have subjected her to torture and cruelty for demand of dowry and there is no iota of evidence against the victim for subjecting her husband to torture and cruelty. Accordingly, Mrs. Samantaray prays to reject the bail application of the Petitioner. Similarly, Mr. M.R. Patra, learned Addl. PP by placing the statement of the victim prays to reject the bail application of the Petitioner.

After having considered the rival submissions upon perusal of record, there appears allegation against the Petitioner for committing rape upon the victim by subjecting her to torture and cruelty and threatening her for demand of dowry, but it is brought to the notice of the Court that the husband of the Petitioner has reported against the victim on 15.05.2023 which was in fact not registered as submitted. Further, in the meantime, after completion of investigation, charge sheet has already been submitted, but the Petitioner is in custody since 26.08.2025. Although the FIR against the Petitioner was registered on 01.09.2023, but he was only arrested in the year 2025 after two years and in the meantime, charge sheet has already been submitted. In view of the above facts and taking into consideration the entire materials placed on record together with the inherent right of the

accused to be presumed innocent until proven guilty at the trial and taking into account the circumstance of implication of the Petitioner, this Court without expressing any view on merit admits the petitioner to bail.

Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it including the following conditions:-

(i) the petitioner shall not contact the victim or visit her house or village and

¶25

(ii) the petitioner shall not threaten/ induce/influence/coerce any of the witnesses including the victim and her family members acquainted with the facts of the case so as to dissuade them from disclosing such facts before the Court.

Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules.
