This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Berhampur PS Case No.14 of 2026 corresponding to CT Case No.55 of 2026 pending in the file of learned SDJM, Nilgiri for commission of offences punishable U/Ss.318(4) of BNS, on the main allegation of deceiving the informant for a sum of Rs.3,60,000/- on the pretext of sanctioning a loan of Rs.30,00,000/- to him, but ultimately not sanctioning any loan.

Heard, Mr. Bijay Kumar Behera, learned counsel for the petitioner and Mr. C. Mohanty, learned Additional Public Prosecutor in the matter and perused the record. 4. No doubt five criminal cases registered against the petitioner has been advanced as a ground for opposing the prayer for bail to the petitioner, but the petitioner is in custody since 08.02.2026 and in the meantime, charge-sheet has already been submitted, however, the petitioner is a lady and she, thereby, qualifies for bail in view of proviso

appended to Sec.480 of BNSS. In the aforesaid facts and situation and on consideration of the materials placed on record together with the offences alleged being triable by magistrate and applying the law laid down by the Apex Court in Satender Kumar Antil Vrs. Central Bureau of Investigation; (2022) 10 SCC 51 , this Court without expressing any view on merit admits the petitioner to bail.

Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-Five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions except cash surety as deem fit and proper by it.

Accordingly, the BLAPL stands disposed of. 7. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
