01. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Bissamcuttack P.S. Case No. 55 of 2026 corresponding to G.R. Case No. 115 of 2026 pending in the file of learned JMFC, Bissamcuttack, for commission of offences punishable U/Ss. 305(a)/331(4)/317(2) & 3(5) of BNS, on the main allegation of receiving stolen gold and silver ornaments.

Heard, Mr. Panchanan Panigrahi, learned counsel for the petitioner and Mr. M.R. Patra, learned Addl. PP in the matter and perused the record.

Admittedly, the petitioner was granted bail by this Court in BLAPL No. 4893 of 2026, but subject to verification of his criminal antecedent for not more than two criminal antecedents, however, the petitioner was found to have more than two criminal antecedents and accordingly, the benefit of the said order was not extended to the petitioner. Further, the petitioner is in custody since 20.04.2026 and in the meantime, charge sheet has already been submitted. In view of the aforesaid facts and circumstances and on

consideration of materials placed on record and taking into account the offences alleged against the petitioner being triable by Magistrate and thereby, applying the law laid down by the Apex Court in Satender Kumar Antil Vrs. Central Bureau of Investigation; (2022) 10 SCC 51 , this Court without expressing any view on merit, admits the petitioner to bail.

Hence, the bail application of the Petitioner stands allowed and the Petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions except cash surety as deem fit and proper by it.

Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
