ORDER(ORAL):10.09.2026 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Champua PS Case No.169 of 2026 corresponding to GR Case No.297 of 2026 pending in the file of learned SDJM, Champua, in the district of Keonjhar, for commission of offences punishable U/Ss.331(3)/305(a) of BNS, on the main allegation of committing theft by trespassing into the house of the informant and taking away cash of Rs.20,000/- and jewellery worth Rs.85,000/-.

Heard, Mr. Umakanta Barik, learned counsel for the petitioner and Mr. R.B. Mishra, learned Additional Public Prosecutor in the matter and perused the record. 3. No doubt, the bail application of the petitioner was opposed to by the learned State Counsel for the petitioner having five criminal antecedents, but the FIR has been registered against unknown persons and the implication of the petitioner is primarily on the basis of confession before the police. In the aforesaid premises and on consideration of materials placed on record together with the pre-trial detention of the petitioner in custody since 08.06.2026 with submission of charge-

sheet in the meantime and taking into account the other circumstances on record in entirety including the inherent right of the accused-petitioner to be presumed innocent until proven guilty at the trial and the mode & manner of implication of the present petitioner in this case, this Court without expressing any view on merit admits the petitioner to bail.

Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twentyfive Thousand) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions except cash surety as deem fit and proper by it with following condition:-

(i) the petitioner shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday of each month in between 10 A.M. to 12 Noon for four(04) months from the actual date of release from the custody.

The IIC of jurisdictional Police Station shall not detain the petitioner unnecessarily after recording his attendance beyond the time as stipulated.

Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
