01. 1. Mr. Arijeet Mishra, learned counsel for the petitioners by filing a memo seeks permission of the Court to withdraw the bail application of petitioner no.2- Sk. Lalu @ Golu by praying to grant liberty to the petitioner no.2 to renew his prayer for bail after submission of charge-sheet by disclosing the details of his criminal antecedents and accordingly, the prayer for bail qua the petitioner No.2- Sk. Lalu @ Golu stands disposed of as withdrawn with aforesaid liberty as prayed for. The present bail application is only confined to petitioner no.1- Jayadev @ Jayadev Mandal @ China. 2. This is an application U/S.483 of BNSS by the petitioner Jayadev @ Jayadev Mandal @ China for grant of bail in connection with Jajpur Road P.S. Case No. 359 of 2026 corresponding to CT Case No. 969 of 2026 pending in the file of learned JMFC, Jajpur Road, for commission of offences punishable U/S. 310(4)/ 310(5) of BNS r/w Sec.25 of Arms Act, on the main allegation of congregating in an isolated place being armed with deadly weapons, along with co-accused persons and preparing to commit dacoity.

learned Addl. Public Prosecutor in the matter and perused the record.

After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the pretrial detention of the petitioner Jayadev @ Jayadev Mandal @ China in custody since 08.06.2026 with substantial progress in investigation and taking into account the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial and no materials being collected against the petitioner to suggest that the petitioner would abscond or pose threat to the witnesses, if released on bail, this Court without expressing any view on merit admits the petitioner Jayadev @ Jayadev Mandal @ China to bail.

Hence, the bail application of the petitioner Jayadev @ Jayadev Mandal @ China stands allowed and the petitioner Jayadev @ Jayadev Mandal @ China is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-Five Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions except cash surety as deem fit and proper by it.

Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail
