The Petitioners are accused in connection with C.T. Case No. 183 of 2026 pending on the file of learned S.D.J.M., Bhawanipatna, arising out of Bhawanipatna Town P.S. Case No.81 of 2026 for commission of offence alleged under Sections 326(g) of BNS.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioners relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of their application for bail U/s.483 of the BNSS by the learned Addl. Sessions Judge-Cum-Special Judge (Vigilance), Bhawanipatna by order dated 08.05.2026

in the aforementioned case, the present BLAPL has been filed.

The case of the prosecution is that on 02.03.2026 at mid night when the informant and his family members were asleep, his brothers woke up and found that the informant’s motorcycle, a Glamour MC having Regd. No- OD 08 G 4762 was on fire. When he tried to open the door someone locked the door from outside. They called him over phone and opened the door. By that time, his vehicle was burnt and some of the houses were going to catch the fire. However, the fire was extinguished in time, thereby preventing a major mishap. The informant suspected that the present petitioners might have committed the said act of mischief owing to previous enmity between them. Basing on such report, the aforementioned P.S. case was registered.

It is submitted by the learned counsel for the Petitioners that they are in custody since 03.03.2026 and on instruction that in the case at hand charge sheet has been filed on 08.06.2026 under Section 326(g) of the BNS, he prays that Petitioners may be enlarged on bail.

It is stated that admittedly the motor cycle was torched in the alleged incident, and no one was injured.

Considering such submission, this Court directs the Petitioners shall be released on bail on

such terms to be fixed by the learned Court in seisin subject to verification of criminal antecedent and also subject to the verification of fact as to whether any person was injured in the alleged incident.

If it comes to fore that the Petitioners have any criminal antecedent and that any person was injured in the alleged incident, this order shall not be given effect to.

Additionally, it is directed that the Petitioners shall appear before the jurisdictional police station once every month on such date and time to be fixed by the learned Court in seisin for the next three months. Certification of such appearance shall be submitted to the Court in seisin.

Accordingly, the BLAPL stands disposed of. U.C.C as per rules.
