1. Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are accused in connection with C.T. Case No.49 of 2026 pending on the file of learned Additional Sessions Judge, Koraput, arising out of Padwa P.S. Case No. 11 of 2026 for commission of offence alleged under Sections 3(5), 85 and 109 of BNS, 2023.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioners relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of their application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Additional

Sessions Judge, Koraput by order dated 01.05.2026 in the aforementioned cases, the present BLAPL has been filed.

The prosecution case, in brief, is that on 21.01.2026, the complainant, Tankadhar Machha, reported that his daughter, Anwesha Machha, was subjected to physical and mental cruelty by her husband, Asis Sukri, and his family members in connection with dowry demands. He further alleged that on the same day, she died under suspicious circumstances and suspected that her husband and his family members had caused her death. On the basis of the report, Nandapur P.S. Case No. 11 dated 21.01.2026 was registered under Sections 80, 103(1), and 3(5) BNS, and investigation was taken up.

It is submitted by the learned counsel that the Petitioners, who are the parents-in-law are in custody since 25.01.2026. 7. Learned counsel for the Petitioner further submits that though the FIR was instituted, inter alia, under Section 103(1) of the BNS, referring to the chargesheet which is on record submits that the same has been filed on 20.03.2026 under Section 3(5)/85/108 of the BNS.

It is also submitted by the learned counsel referring to the recital of the chargesheet, that the

overt act which led to the unfortunate incident is attributed to the husband of the deceased i.e. son of the Petitioners.

Such submission is opposed by the learned counsel for the State.

Considering the rival submissions, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin so as to ensure his presence during the trial.

Accordingly, the BLAPL stands disposed of. 11. Urgent certified copy of this order be granted as per rules.
