01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with C.T(Sessions) Case No.48 of 2026, pending on the file of learned Sessions Judge, Jharsuguda, arising out of Brajarajnagar P.S. Case No.25 of 2026 , for commission of alleged offences under Sections 69/ 318(2)/ 296/ 351(3) of BNS.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.483 of BNSS by the learned Sessions Judge, Jharsuguda, by order dated 07.04.2026 in the aforementioned case, the present BLAPL has been filed.

The allegation against the present Petitioner is that, on the pretest of marriage, the Petitioner kept physical relationship with the victim.

It is submitted by the learned counsel for the Petitioner that considering the nature of allegation and since charge sheet has already been submitted in the meanwhile, further continuance of the Petitioner in custody is punitive. Hence, he may be released on bail.

Such submission is opposed by the learned counsel for the State.

This Court perused the 183 BNSS statement of the victim.

Considering the same and the submissions made, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.
