Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with G.R. Case No.247 of 2026 pending on the file of learned S.D.J.M., Khordha, arising out of Khordha Sadar P.S. Case No.85 of 2026 for commission of

offence alleged under Sections 281/ 303(2)/ 351(2)/ 3(5) of BNS read with Section 11(1)(a)(d) of Prevention of Cruelty to Animals Act, 1960.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of their application for bail U/s.483 of the BNSS by the learned 2^nd Addl. Sessions Judge, Khordha by order dated 12.03.2026 in the aforementioned case, the present BLAPL has been filed.

It is the case of the prosecution, in short, is that on 28.02.2026 about 01.10 A.M. the informant having received information that the Petitioner along with co-accused committed theft of 20 nos of Buffalos and transferred through one vehicle bearing regd. No.KA 07 B 7435 from Cuttack to Karnataka in cruelty manner, he along with his team managed to apprehend the driver of the said vehicle near Pandit Dhaba. At that time, one accused namely Moti threatened them to kill in life and fled away. Hence, he reported and the PS case in question has been registered.

It is submitted by the learned counsel that the Petitioner is in custody from 28.02.2026 and since charge sheet has been submitted on 28.04.2026, Petitioner may be released on bail.
