1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with C.T. Case No.1487 of 2025 pending on the file of learned SDJM, Rairangpur arising out of Gorumahisani P.S. Case No.126 of 2025 for commission of offence alleged under Section 5 of Explosive Substances Act.

The prosecution case is that on 27.11.2025 at about 2:10 AM, the informant lodged an FIR as directed by the IIC, Gorumahisani Police Station, vide C.C. No. 0859066 dated 26.11.2025. On 26.11.2025 at about 10:10 PM, the informant along with police staff proceeded in PS vehicle No. CD-05M-0745 to verify information regarding suspicious activities at

Ganeshdahi, Nuadihi village. Near Nuadihi, they noticed two persons on a red-coloured motorcycle who, on seeing the police, tried to flee but were intercepted near Marchagoda bridge. On search, a plastic sack containing 175 detonators and about 300 meters of red-coloured cable was recovered. The accused failed to produce any license and stated they had purchased the materials from “Jena Babu” of Bada Kerka. The accused, namely Chandra Kishor Nayak (45)-Petitioner and Jasai Marndi (22) of PS Tiring, District Mayurbhanj, were apprehended and taken into custody.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court. 5. Being aggrieved by the rejection of his applications for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Additional Sessions Judge, Rairangpur by order dated 20.01.2026 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the Petitioner is in custody since 28.11.2025. As, in the meanwhile charge sheet has been submitted, hence, the Petitioner may be released on bail.

Learned counsel for the State opposes such prayer for bail.

Considering the rival submissions, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin so as to ensure his presence during the trial subject to verification of criminal antecedent of similar nature. 9. If it comes to the fore that the Petitioner has any such criminal antecedent, this order shall not be given effect to.

Additionally, it is directed that the Petitioner shall appear before the jurisdictional Police Station once a month for the next three months.

Accordingly, the BLAPL stands disposed of.
