The Petitioner is an accused in connection with C.T. Case No.222 of 2025 pending on the file of learned Addl. Sessions Judge-cum-Special Judge, Koraput, arising out of Laxmipur P.S. Case No.104 of 2025 for commission of offence alleged under Sections 310(2)/111(4) of BNS.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of their application for bail U/s.483 of the BNSS by the

learned Addl. Sessions Judge, Koraput by order dated 06.03.2026 in the aforementioned case, the present BLAPL has been filed.

It is the case of the prosecution, in short, is that on 04.08.2025 at 9.42 P.M. informant lodged a written report alleging therein that on 04.08.2025 he along with his son Subham and his driver started journey from Koraput to Berhampur in their Innova car. After passing Laxmipur near Pondakapadar Chhowk they stopped the vehicle to ease themselves. All of sudden about 10/12 people armed with lathis came near them, assaulted and snatched away his gold chain and cash of Rs.1,00,000/- and mobile handset as well as two bags containing clothes and document of his son. Hence, the PS case in question was instituted.

It is submitted by the learned counsel that the Petitioner is in custody since 08.07.2025 and the FIR is against unknown and in the meanwhile all the co-accused have been released on bail and since the charge sheet in the case hand has been filed on 02.11.2025, Petitioner may be released on bail.

Learned counsel for the State opposes such prayer, inter alia, referring to the antecedents of

the Petitioner, which has been reflected in the order passed by the trial Court.

Referring to the antecedents, it is the submission of the learned counsel for the Petitioner that because of the antecedents, the Petitioner has been falsely roped in the case at hand and that ought not to weigh with this Court in considering his complicity in the case at hand in the light of the materials on record.

Admittedly, there is no TI parade of either the materials or the accused. 10. And, it is borne out from the case diary that there has been recovery of about Rs.70.,000/- from other accused persons.

In the backdrop of the submission noted as above, considering the period in custody and release of the co-accused, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.

Additionally, it is directed that Petitioner shall appear before the jurisdictional police station once every month on such date and time to be fixed by the learned Court in seisin for the next three months. Certification of such appearance shall be submitted to the Court in seisin.
