1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with G.R Case No. 772/2024, corresponding to SC Case No. 76/2025, pending before the Court of the learned Addl. Sessions Judge, Patnagarh, arising out of Khaparakhol case P.S. Case No. 147/2024 for alleged commission of offences under Sections 493/417/506/306 of IPC.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Addl.

Sessions Judge, Patnagarh by order dated 30.01.2026 in the aforementioned case, the present BLAPL has been filed.

The case of the prosecution is that the Petitioner was in relationship with a lady and taking note of her complaint, initially an FIR was instituted on 18.06.2024 under Sections 493/417/506 of IPC. During the course of investigation of the said FIR, unfortunately she died for which the offence under Section 306 of IPC was added and ultimately on conclusion of investigation final form was submitted under Sections 493/417/506/306 of IPC.

It is submitted by the learned counsel that the Petitioner is in custody since 04.05.2025 and as in the meanwhile charge sheet has been filed and case has not progressed beyond the stage of commitment, he may be released on bail.

Learned counsel for the State opposes the prayer for bail.

This Court perused the statement of the victim recorded under Section 164 Cr.P.C. and other materials on record as submitted by the learned counsel for the State.
