03. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with S.T. Case No.15/02 of 2026, pending on the file of learned Ad-hoc Add. District & Session Judge, (FTSC) (POCSO) Rourkela, arising out of Biramitrapur P.S. Case No.447 of 2025 , for commission of alleged offences under Sections 376(2)(n)/ 294/ 323/ 403/ 506 of IPC.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of his application for bail U/s.483 of BNSS by the learned Ad-hoc Additional District & Sessions Judge (FTSC) (POCSO), Rourkela, by order dated 09.02.2026 in the aforementioned case, the present BLAPL has been filed.

The case of the prosecution in brief is that on 26.09.2025 at about 11:35 P.M. the complainant, namely, Priti Minz stated that the accused Lalit Bara had been in contact with her for the last 11 years and had promised to marry her. On this assurance, he allegedly established physical relations with her on several occasions at Nagpur and later at her quarter at Lahunipada. Subsequently, she came to know that the accused was already married and had three children. When questioned, he allegedly abused and threatened to viral her obscene photos on social media. Based on her written report, R.P. Nag registered PS Case No. 447 dated 26.09.2025 under Sections 376(2)(n)/294/323/403/506 IPC.

It is submitted by the learned counsel that a consensual live-in relationship being given the colour of criminality for which the Petitioner is languishing in custody since 27.009.2025 and as charge sheet has already been filed on 21.11.2025, the Petitioner may be enlarged on bail.

Learned counsel for the State opposes the prayer for bail.

This Court perused the statement of the victim recorded under Section 183 of BNSS and other materials on record.

Considering the same, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin so as to ensure his presence during the trial.
