The Petitioner is an accused in connection with G.R. Case No.44 of 2026 pending on the file of learned J.M.F.C., Motu at M.V-79, arising out of Kalimela P.S. Case No.17 of 2026 for commission of offence alleged under Sections 85/ 296/ 115(2)/ 109(1)/ 74/75(2)/ 351(2)/ 304(2)/ 326(f) and 3(5) of BNS read with Section 4 of D.P Act.

Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

Being aggrieved by the rejection of their application for bail U/s.483 of the BNSS by the learned Sessions Judge, Malkangiri by order dated

10.02.2026 in the aforementioned case, the present BLAPL has been filed.

The allegation against the present Petitioner is that he caused injury to his wife.

It is submitted by the learned counsel that since the Petitioner is in custody 24.01.2026 and charge sheet has been filed on 21.04.2026 and the injury suffered has been categorized as simple in nature, the Petitioner may be enlarged on bail.

Learned counsel for the State opposes such prayer for bail.

Considering the nature of allegations, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin so as to ensure his presence during the trial.

It is directed that the Petitioner shall not in any way try to intimidate or threaten the Informant or her family.

It shall be open for the prosecution/Informant to seek variance of this order, if there is any threat perception.
