The Petitioner being in custody in Manamunda P.S. Case No.221 of 2026, corresponding to Special Case No.15 of 2025 (POCSO Act) pending in the court of learned Additional Sessions Judge-cum- Special Judge, Boudh , registered for the alleged commission of offences under Section 137(2)/64(2)(m) of BNS, 2023 read with Section 6 of the POCSO Act and Section 3(1)(w)/3(2)(va) of the SC and ST (PoA) Act, has filed this petition for his release on bail.

The brief fact of the case is that on 27.07.2025, the informant, who is the father of the victim, lodged a written report before the IIC, Manamunda P.S., alleging that on the same day at about 7 A.M., his daughter had gone to the village pond in a cycle loaded with one utensil to take a bath. But, she did not return. He searched her in a probable place, but the same was in vain. He found the utensil was lying near the pond and the cycle was found near Metakani. Based on the said report, Manamunda P.S. Case No.221 of 2025 has been registered. Hence, this case.

Learned counsel for the Petitioner submits that the Petitioner and the victim had love relationship for a long time. The father of the victim had lodged an FIR against the Petitioner. custody since 08.10.2025. Hence, he submits that the Petitioner may be enlarged on bail.

On the other hand, learned counsel for the State submits that there is prima facie material for the alleged offences. Hence, he vehemently opposes the prayer for bail of the Petitioner.

Without going into the merit of the case and based on the facts and circumstances of the case, it is directed that the Petitioner be released on bail in the aforesaid case with some stringent terms and conditions as deemed just and proper by the learned court in seisin over the matter with further conditions that:-

i. The Petitioner shall appear before the local Police Station on every alternate Sunday between 10.00 A.M. to 12.00 P.M. till conclusion of the trial.;
