02. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.

These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Jagdalpur P.S. Case No. 145 of 2025 corresponding to Special G.R. Case No. 50 of 2025 pending in the file of learned Addl. Sessions Judge, Padampur, for commission of offences punishable U/Ss. 20(b)(ii)(C)/29 of NDPS Act, on the allegation of jointly possessing and transporting 60Kgs 480Grams of Contraband Ganja in two motorcycles; one without registration number and the other one bearing Regd. No. OD-17-M-7996.

Heard, Mr. Jagabandhu Sahu, learned counsel for both the petitioners and Mr. P. Satpathy, learned Addl. PP in these matters and perused the record.

After having considered the rival submissions and taking into consideration the nature and gravity of the offence as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the recovery and seizure of 60Kgs 480Grams of Contraband Ganja, which is well above the commercial quantity from the motorcycles allegedly in possession of the petitioners and their consequent failure to satisfy the conditions of Section 37 of NDPS Act, which is sine qua non for grant of bail for commission of offence under NDPS Act involving commercial quantity, this Court is not inclined to grant bail to any of the petitioners.

Hence, the bail applications of each of the petitioners namely Anurag Verma @ Baba (BLAPL No. 13758 of 2025) and Pappu Kumar @ Pappu Dhuru (BLAPL No. 13597 of 2025) stand rejected.

Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
