This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Nilagiri PS Case No. 141 of 2025 corresponding to CT Case No.235 of 2025 pending in the Court of learned SDJM, Nilgiri being charge sheeted for commission of offences punishable U/Ss. 85/103(1)/3(5) of the BNS, on the main allegation of committing murder of his wife by subjecting her to torture and cruelty, along with coaccused persons in furtherance of their common intention.

Heard, Mr. Sanjib Kumar Bhanjadeo, learned counsel for the petitioner and Mr. C. Mahanty, learned Addl. Public Prosecutor in the matter and perused the record.

After having considered the rival submissions upon perusal of record, there appears allegation against

the Petitioner for feeding poison to the deceased and the PM report in which the opinion as to cause of death of the deceased has been kept reserved by the doctor reveals that the internal findings of stomach are ante mortem in nature and such internal changes in stomach is consistent with ingestion of some toxic irritant substance. In the aforesaid facts and circumstances, especially when there is allegation against the Petitioner for keeping illicit affairs with another lady and feeding poison to his own wife and taking into account the other circumstances on record in entirety, this Court does not consider it proper to grant bail to the Petitioner at this stage.

Hence, the bail application of the petitioner stand rejected. Accordingly, the BLAPL stands disposed of. A soft copy of the order be immediately sent to the learned trial Court.
