Heard learned counsels for the Petitioner and learned counsel for the State.

The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.679 of 2025 pending in the Court of learned J.M.F.C., Dhamanagar, arising out of Dhamanagar P.S. Case No.300 of 2025 for commission of offence punishable under Sections 305(a)/ 3(5) of BNS, 2023.

It is submitted by the learned counsel that the basis of implication is on account of the coaccused statement and the Petitioner has no criminal proclivity. Hence, he may be protected by pre-arrest bail.

Learned counsel for the State opposes such prayer during the currency of investigation.

Taking into account the nature of allegations and the submission made by the learned counsel for the Petitioner, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent. 6. If it comes to fore that the Petitioner has any criminal antecedent, this order shall not be given effect to.
