Heard learned counsel for the respective parties.

Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Brajarajnagar P.S. Case No.9 of 2026 corresponding to C.T. Case No.18 of 2026 pending in the file of learned J.M.F.C.-1, Jharsuguda on the grounds stated therein.

Perused the FIR as at Annexure-1. The alleged incident is narrated therein. A case under Section 109 BNS has been registered against the petitioner. It is claimed that the assault was made by means of a knife and it was at the behest of the petitioner and other accused persons. Today, learned counsel for the State produced a copy of the medical examination report of one Krishna Rout, who received two simple injuries one being abrasion. The injuries do not commensurate the assault by means of knife. Considering the circumstances under which

the alleged incident took place and the submissions of the learned counsel for the respective parties, this Court though not inclined to consider the plea of pre-arrest bail of the petitioner, however, is of the view that he should be directed to surrender before the learned counsel below for being released with stringent conditions.

4. Accordingly, it is ordered.

In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioner surrenders within a fortnight from today before the learned J.M.F.C.-1, Jharsuguda in connection with Brajarajnagar P.S. Case No.9 of 2026 corresponding to C.T. Case No.18 of 2026, he shall be released on bail subject to him on furnishing a bail bond of Rs.30,000/(Rupees thirty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall not cause any harm to the informant and to report the I.O. as and when called upon for the purpose of investigation, till its completion.
