Heard learned counsel for the respective parties.

Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Balanga P.S. Case No.129 of 2025 corresponding to C.T. Case No.617 of 2025 pending in the file of learned J.M.F.C., Nimapara on the grounds stated therein.

Perused the FIR as at Annexure-2. The petitioner had earlier approached this Court vide ABLAPL No.9531 of 2025 disposed of on 16^th September, 2025 with the connected ABLAPLs directing him to surrender before the court concerned seeking regular bail for its consideration on merit. Recorded the objection of the State. It is submitted by the learned counsel for the petitioner that the petitioner was since outside at the relevant point of time could not comply the order in the ABLAPL (supra). In view of the submission as above and the plea of parity for the release of the co-accused persons and the fact that investigation is concluded with the filing of

chargesheet in the meantime, this Court is inclined to direct the petitioner to surrender before the learned court below seeking regular bail for consideration.

4. Accordingly, it is ordered.

In the result, the ABLAPL stands disposed of in the above terms. It is directed that in the event, the petitioner surrenders before the learned J.M.F.C., Nimapara in connection with Balanga P.S. Case No.129 of 2025 corresponding to C.T. Case No.617 of 2025 within a period of fifteen days from today and upon compliance of the same, moves an application for regular bail, it shall be dealt with in accordance with the direction as aforesaid.
