Heard learned counsel for the respective parties.

Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with Nilgiri P.S. Case No.10 of 2026 pending in the file of learned SDJM, Nilgiri corresponding to C.T. Case No.14 of 2026 on the grounds stated.

Gone through the FIR as at Annexure-1. The case diary is produced and the same is perused. The medical examination report of the injured is submitted to the Court and on perusal of the same, it is revealed that the victim, namely, Ghanashyam @ Bhagaban Jena received lacerations but simple in nature and with regard to internal injuries, opinion is reserved. Learned counsel for the State submits that the final opinion has not been received. It is informed to the Court that the assault on the head of the victim was at the instance of one Baishakha Patra @

Lucky in presence of the petitioners and such assault was by means of a lathi. Considering the fact that the injuries caused to the victim is directed against the co-accused, who is stated to have been arrested and released in the meantime and not the petitioners, who claim to have no other similar antecedent, this Court is inclined to direct both of them to surrender before the learned court below for being released with stringent conditions instead of accepting their plea for pre-arrest bail.

4. Accordingly, it is ordered.

In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioners surrender before the court of learned SDJM, Nilgiri within a fortnight from today, it is directed that they shall be released on bail in connection with Nilgiri P.S. Case No.10 of 2026 corresponding to C.T. Case No. 14 of 2026 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) each with one solvent surety for the like amount each with the following conditions, such as, they shall not cause any harm to the informant while on bail and to cooperate the I.O. in the investigation as and when called upon.
