02. 1. Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.482 of 2026 pending on the file of learned J.M.F.C., Chandikhole, arising out of Dharmasala P.S. Case No.109 of 2026 for commission of offences punishable under Sections 126(2), 115(2), 117(2), 296, 118(1), 351(2) and 3(5) of BNS, 2023. 3. Learned counsel for the State as well as informant oppose the prayer for pre-arrest bail, inter alia, on the ground that though the injuries suffered are

simple in nature they are on the vital part such as nose and ear. Hence, no leniency ought to be shown.

Taking into account the nature of allegations, the injuries suffered and that the Petitioners do not have any criminal proclivity, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature.

If it comes to the fore that the Petitioners have any such criminal antecedent, this order shall not be given effect to.

Additionally, it is directed that the Petitioners shall appear before the jurisdictional Police Station once a month for the next three months on such date and time to be fixed by the learned Court in seisin or till submission of final form whichever is earlier. Certification of such appearance shall be submitted to the learned Court in seisin.

It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

Accordingly, the ABLAPL stands disposed of.
